1. Acceptance and eligibility
These Terms of Use ("Terms") apply to Guardian: Curriculum Review ("Guardian" or the "App"), operated by 1001463290 ONTARIO INC. By downloading, accessing, purchasing, or using Guardian, you agree to these Terms and our Privacy Policy.
Guardian is designed for adults acting as parents or legal guardians. It is not intended for children to use independently. You may use Guardian only if you can legally enter into this agreement and only for lawful parent or guardian review of school materials.
Apple’s Standard End User License Agreement applies to the App. These Terms supplement that agreement. If these Terms conflict with Apple’s Standard EULA on a matter governed by the EULA, the EULA controls.
2. Accounts and access
Some features require a Guardian account and Sign in with Apple. You are responsible for maintaining control of your Apple account and device, providing accurate information, and promptly notifying support if you believe your Guardian access has been compromised.
Do not share verification codes, recovery credentials, session tokens, or parent-generated support codes with anyone except Guardian support through the designated support process. Support will not bypass account ownership checks.
3. Subscriptions, trials, and billing
Guardian offers auto-renewable subscriptions purchased through Apple’s In-App Purchase system. Before you confirm a purchase, Apple displays the current localized price and billing period. Apple charges your Apple account after confirmation.
If Apple determines that your account is eligible for an introductory trial or offer, Guardian may display that offer using information supplied by StoreKit. Unless canceled before the offer ends, the subscription converts to the paid plan shown at purchase confirmation.
Subscriptions renew automatically unless canceled at least 24 hours before the end of the current subscription period. Apple may charge your account for renewal within 24 hours before the period ends. You can manage or cancel a subscription in your Apple subscription settings.
Deleting Guardian or deleting your Guardian account does not cancel an Apple subscription. Purchase restoration and refunds are subject to Apple’s systems and policies. Guardian cannot cancel an Apple subscription on your behalf.
4. Review results and parent judgment
Guardian provides informational curriculum-review support. Results may include AI-assisted analysis, OCR, summaries, public-source references, evidence-strength indicators, conversation guides, and message drafts. Automated and public-source results can be incomplete, unavailable, outdated, or wrong.
You are responsible for reviewing the original source, context, citations, and any draft before relying on it or sharing it. Guardian does not speak for a school, teacher, district, board, government, publisher, or source provider, and it does not guarantee that a public source is the material assigned to your child.
Guardian does not replace your judgment, direct school communication, legal advice, medical advice, professional educational advice, or emergency services. You remain responsible for deciding whether and how to contact a child, teacher, school, district, board, or other person.
5. School materials and content you provide
You retain your rights in content you submit. You grant Guardian a limited permission to host, copy, process, analyze, and transmit that content only as reasonably necessary to operate, secure, support, and improve the service as described in the Privacy Policy.
You represent that you have the right or lawful basis to submit and review the material. Do not upload unnecessary student records, another person’s private information, or content you are not permitted to use.
Public-source material, publisher content, school materials, names, and trademarks may belong to third parties. Guardian does not grant you rights in third-party content beyond those available under applicable law.
6. Acceptable use
You may not:
- Use Guardian unlawfully or to harass, threaten, defame, impersonate, discriminate against, or target another person.
- Upload content you do not have permission or a lawful basis to review.
- Attempt to gain unauthorized access, bypass account or purchase controls, probe security, introduce malicious code, or disrupt Guardian or its providers.
- Reverse engineer, scrape, copy, resell, or exploit Guardian except where applicable law expressly permits it.
- Present AI-assisted output as verified original source text when it is not, or falsely claim that Guardian sent a parent’s message to a school.
7. Availability, changes, and suspension
Guardian depends on Apple, hosting, AI, public-source, publisher, school, district, and other third-party systems. We may change, improve, limit, or discontinue a feature, and a source or service may become unavailable. We do not guarantee uninterrupted operation or that every textbook, worksheet, district, or curriculum source can be found or reviewed.
We may limit or suspend access when reasonably necessary to protect Guardian, users, providers, or others; investigate suspected misuse; comply with law; or enforce these Terms. You may stop using Guardian at any time and may request account deletion as described in our Data Deletion Instructions.
8. Disclaimers and limitation of liability
To the maximum extent permitted by applicable law, Guardian is provided "as is" and "as available," without warranties that review results will be complete, error-free, or suitable for a particular decision. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
To the maximum extent permitted by applicable law, 1001463290 ONTARIO INC. will not be liable for indirect, incidental, special, consequential, or punitive damages, or for losses caused by reliance on an unverified result, third-party source, unavailable service, or a message or action you choose to take. These limitations do not apply where prohibited by law.
9. General terms
These Terms and the Apple Standard EULA are the agreement governing your use of Guardian. If a provision is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer these Terms as part of a merger, financing, reorganization, or sale of the business or service.
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules, except that mandatory consumer protections in your place of residence continue to apply.
We may update these Terms as Guardian changes. The effective date above reflects the current version. Material changes may also be communicated in the App or on this page. Continuing to use Guardian after updated Terms take effect means you accept them, to the extent permitted by law.
